Laws

To clean up voter rolls the right way, we need to understand election laws. This includes both state and federal rules.

Federal Law

Two key federal laws are:

The National Voter Registration Act of 1993 (NVRA) regulates voter registration and implements so-called “motor voter” laws.

The Help America Vote Act of 2002 (HAVA) was the result of the 2000 Bush v. Gore election debacle in Florida. It regulates election equipment and provides funding for states and counties to upgrade their election systems. The version linked here is a passed by Congress and signed by the President. It was initially published as a Title 42 document. The sections have since been renumbered and the transferred to a Title 52 document. Both versions can be referenced in a court pleading.

State Law

State law is embodied largely in the California Elections Code. Division 2 Chapters 2 and 3 include most of the sections needed for our efforts to ensure compliance.

The state also produces a manual for compliance with NVRA:

Court Precedent

This is at best a partial list.

The issue in that case was whether states had the right to send voter confirmation cards due to voter inactivity.
